The Financial Rights Legal Centre Inc. ABN 40 506 635 273 (Financial Rights – ‘we’ ‘us’ and ‘our’ in this notice) oversees the Financial Rights Legal Centre.
We comply with the Privacy Act 1988 (Cth) (Privacy Act) when collecting, using, disclosing and managing personal information. This notice should be read in conjunction with our privacy policy which outlines our policies and practices for the collection, use, disclosure, and management of the personal information that we hold. In this notice ‘personal information’ means information or an opinion about an identified individual, or an individual who is reasonably identifiable, whether the information or opinion is true or not and whether the information or opinion is recorded in a material form or not.
What types of personal information may Financial Rights collect?
Generally, the kinds of personal information that we may collect from you when you seek legal services and/or financial counselling include:
- contact and identification information such as your name, date of birth, gender, postcode and suburb, country of birth, email address, and phone number;
- names of the other parties involved in your dispute (if any);
- your ethnicity, including Indigenous status;
- your health information including any mental or physical health conditions you have now or previously had, and any information about health service provision;
- your Centrelink status; and
- any criminal history.
Why does financial rights need your personal information?
We collect your personal information for the purpose of providing legal services and/or financial counselling, and any administrative or ancillary purposes connected to providing legal services and/or financial counselling. We may also collect your personal information where required by law.
You are under no obligation to provide your personal information to us. However, without certain information from you, or where information provided is inaccurate, incomplete, or irrelevant, we may not be able to provide you with the legal services or financial counselling sought.
Use and disclosure of personal information
We use and disclose your personal information for the purposes for which we collect it. That is, generally, we will only use or disclose your personal information for a purpose related to the provision of legal services and/or financial counselling services. This may include disclosing your personal information to:
- third parties (with your consent) for the purpose of advice, counselling, support or representation;
- funders (including government agencies) on an aggregate, non-identifying level to meet our funding obligations that we are providing services to the cohorts of consumers identified as requiring our services.
This disclosure is always on a confidential basis or otherwise in accordance with law.
There would be very limited circumstances in which we would need to disclose your personal information outside of Australia. In the event we did need to make such disclosure, we would only do so to a recipient outside of Australia where we reasonably believe that the recipient of the personal information is subject to a law, binding scheme, or contract which effectively upholds principles for the handling of the information that are substantially similar to the Australian Privacy Principles in the Privacy Act or with your consent.
Access to your personal information held by Financial Rights
Under the Privacy Act you have the right to gain access to your personal information that we hold. You also have the right to ask us to correct your personal information that we hold in accordance with the Privacy Act.
